1. Introduction

This Privacy and Data Protection Policy ("Policy") outlines how BSP Media Group (the "Company") collects, uses, and protects the personal and professional data of its Users.

This Policy applies to all Content Contributors, Content Acquirers, and general Members of the BMA Content Hub.

2. Data Ownership and Confidentiality

  • Subscriber Data: All names and data of Subscribers acquired through the Platform remain the exclusive property of the acquiring party or the Company as defined by their specific service relationship.
  • Confidential Information: The Company and all Users shall keep secret and confidential all provisions of any agreements, as well as information regarding any party's trade and business practices.
  • Disclosure Restrictions: No party shall disclose confidential information to any third party except in compliance with an involuntary legal disclosure obligation.
  • Employee Access: Parties shall only divulge confidential information to such employees as have a strict "need to know" for the performance of the Agreement.

3. Information We Collect

We collect information necessary for the operation of a B2B media marketplace, including:

  • Professional Identity: Name, job title, and company affiliation to verify B2B eligibility.
  • Contact Details: Professional email addresses and telephone numbers.
  • Account Metadata: Information regarding content listings, search history, and saved favourites to provide tailored recommendations.
  • Financial Data: Billing information for subscription tiers (Professional, Business, Enterprise).

4. Data Sharing Between Contributors and Acquirers

To facilitate the "Discovery and Match" function of the Hub, data is shared as follows:

  • Discovery Metadata: Content metadata (synopses, trailers, and posters) is shared with verified Content Acquirers.
  • Negotiation Data: When an inquiry is made, the Acquirer’s professional contact details are shared with the Content Contributor to facilitate direct licensing discussions.
  • Screening Analytics: Content Contributors may receive reports on which Acquirers have viewed their trailers or requested "mini-bibles" to assist in their sales strategy.

5. Data Security and Integrity

  • Encryption: We use industry-standard encryption for all personal and corporate data stored on our servers.
  • Auditing: The Company maintains the right to conduct security audits to ensure the integrity of the Platform and prevent unauthorised access to User data.
  • Breach Notification: In the event of a known security breach involving third-party reproduction or unauthorised access, the Company and the affected User shall immediately provide each other with all known information.

6. Use of Content for Promotional Purposes

  • Logos and Marks: Content Contributors allow the Company to use their Marks (logos and trademarks) solely in connection with promoting the commercial distribution of the Content on the Platform.
  • Likeness: The name or likeness of any person appearing in programming may not be used for separate promotion unless the Contributor has obtained the necessary clearances.

7. Your Rights and Data Retention

  • Access and Correction: Users have the right to review and update their professional records at any time via the "Account Settings" dashboard.
  • Retention: We retain professional records for as long as an account is active, and for a period of five years thereafter to comply with auditing and tax requirements.
  • Deletion: Upon account termination, personal data will be deleted unless retention is required for legal or financial reporting.

8. Governing Law and Jurisdiction

This Privacy Policy is regulated by UK Law. Any disputes regarding data protection that cannot be resolved through negotiation shall be submitted to the exclusive jurisdiction of the relevant courts in accordance with the Platform's main Terms and Conditions.
